ABSTRACT


The intersection of gender and law in India is a complex and multifaceted field that has been shaped by a combination of social, cultural, and economic factors. Despite the country's constitutional commitment to gender equality, women and other marginalized groups continue to face significant challenges in their daily lives. This article examines the key issues that arise at the intersection of gender and law in India, including constitutional rights, gender-based violence, family law, marital rape, women's health, and intersex rights. The Indian Constitution has enshrined the principle of gender equality, guaranteeing women equal rights and opportunities as men in all spheres of life. However, the reality on the ground is far from equal, with women facing significant barriers in accessing education, employment, and healthcare. The article highlights the importance of constitutional rights in promoting gender equality, including the right to equality, the right to life and personal liberty, and the right to freedom from discrimination.
