ABSTRACT
The Geographical Indications are a distinctive form of intellectual property rights that identify products as originating from a specific geographical region where particular qualities, reputation, or characteristics are essentially attributable to that place of origin. In India, traditional agricultural products such as Darjeeling Tea, Basmati Rice, Alphonso Mango, and Nagpur Orange possess unique characteristics derived from local climatic conditions, traditional cultivation methods, and indigenous knowledge systems. The enactment of the Geographical Indications of Goods (Registration and Protection) Act, 1999, in compliance with the obligations under the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), has provided a comprehensive framework for the registration and protection of the GIs in India. Despite the significant progress, challenges such as lack of awareness among producers, inadequate enforcement mechanisms, market access barriers, and instances of infringement continue to hinder the effective utilization of GI protection. This paper examines the concept, legal framework, significance, and challenges associated with GI protection for traditional agricultural products in India. It further explores the role of GIs in fostering sustainable agricultural development and strengthening the livelihoods of rural communities while preserving India's rich agricultural heritage for future generations.
