Hindu Joint Family Under Family Law: Bridging Traditional Values With Contemporary Legal Challenges

ABSTRACT
The Hindu Joint Family (HJF), formalized in law as the Hindu Undivided Family (HUF), embodies a distinctive legal institution evolving from ancient Vedic traditions to modern statutory provisions in India. This paper explores the transformation of the HJF, emphasizing the radical changes brought by the Hindu Succession (Amendment) Act, 2005, which granted daughters equal coparcenary rights with sons. Despite these progressive legal reforms, profound gaps remain between statutory mandates and actual implementation on the ground. Through doctrinal analysis and review of judicial decisions, this study surfaces core challenges and offers comprehensive reform proposals to enhance the system's relevance and fairness in contemporary Indian society.
