Human Trafficking: A Critical Analysis Of The Legal Framework, Enforcement Challenges And Reform In India

ABSTRACT
Human trafficking has emerged into popular violation of basic human rights that belong to women and children, they’ve been used for commercial sexual exploitation or other exploitative labor or bondage by force. India has been endeavoring to tackle this inhumane problem and protect its women and children from exploitation but lot more is required to translate the existing laws into reality and rehabilitate the victims. This paper seeks to critically examine the existing Indian legal regime on human trafficking having reference to constitutional and statutory laws and their interpretation by courts in respective cases. The cases have not only highlighted the legal issues but have also helped in evolution of victim - oriented approach to the problem of human trafficking. Last but not the least, the paper would also discuss issues related to effective implementation of laws and would make suggestions for required legal and administrative reforms with a view to bring about rehabilitation of victims of human trafficking.
