India’s Mental Health Zealotry - The Loss And Gain Of Balance Through The Amended Mental Health Laws

Reeya Mishra, LL.M., Jain University, Bangalore

ABSTRACT

As a developing country, India has witnessed numerous challenges and its debilitating mental health is one of the most important ones. The international reports and tableaus have time and now regarded India dismissive of the plight of its mentally ills. It might have been true before, but we have enforced modern legislations aimed at protecting the person with mental illness and their rights. The legislations might have been criticized to be too progressive and not in touch with reality but it is commendable to witness the efforts that have gone behind making an all-encompassing legislation that caters to the needs of those who happen to be the primary stakeholders.

The article discusses the development of mental health legislations in India through various mental health care bills. It also applauds the efforts undertaken to comply the mental health legislation with various international conventions, thereby, upholding India’s stand and dignity.
