ABSTRACT


An Independent Judiciary is sine quo non for a free society and a constitutional democracy. Independent judiciary guarantees the realization of rule of law and human rights and also stability and progress of the society. The independence of the judiciary is not only guaranteed by the constitution but also assured by the legislations, conventions, and other practices. Almost all the constitutions of democratic countries provide provisions for the independence of the judiciary. It must be protected from social, economic, and political conditions. In the Democratic setup, the judiciary plays an important and significant role. It is claimed to be the primary function of the government. Judiciary maintains the faith of the people in the government. The judicial division of the government has been the guardian of the conscience of the people and it always upholds the laws of the land. It has been said that the proper and fair functioning of the judiciary is ensured when it is detached from the rest of the organs of the government.
