Introduction To External Aid Of Interpretation Of Statute

INTRODUCTION

A statue is defined as “the will of legislature”. Normally, it denotes the act enacted by the legislature. A statue is thus a written “will” of the legislature expressed according to the form necessary to constitute it as a law of the state, and rendered authentic by certain prescribed forms and solemnities. “Statute” is generally applied to law and regulations of every sort law which ordains permits or prohibits anything which is designed as a statue, without considering from what source it arises. Law is defined so as to include and ordinance, order, bye-law, rule, regulation, notification, etc.

According to Salmond, interpretation or construction is the process by which the courts seek to ascertain the meaning of the legislature through the medium of the authoritative forms in which is expressed.
