Is Death Penalty Necessary?

ABSTRACT

This article is about the Necessity of Capital Punishment in India. The ancient sanction found a place in our rulebooks since the British colonial era & has been held constitutional several times by the Apex Court. However, with changes in time & society, the desirability of the death penalty has become a question of debate in 21st century India. In this article, I have discussed about the historical background of capital punishment in India, Arguments For & Against the death penalty, have also discussed several provisions of capital punishment in the CrPC with case analysis of landmark judgements & in the end I have put forward my suggestions.
