ABSTRACT

The article focuses to reconstruct and critically analyse Kelsen’s view on Validity and Effectiveness in light of the Young Lawyers Association v. State case. It outlines Kelsen’s understanding of the concept of validity and its relation to the effectiveness of the norms. The article also focuses on the facts of the Sabarimala Case. The analysis of the Sabarimala case tends to focus on the impact of the Constitution’s Fundamental Rights on the norms. It gives a systemic account of the effectiveness of the valid norm with regard to the verdict given by the Supreme Court. It also aims to analysis the implications of the Validity and Effectiveness of Norms in the Sabarimala Case.
