Legal Frameworks And Support Mechanisms For Family Affected By Fatal Sexual Assaults In India

ABSTRACT:


The victimization of families affected by fatal sexual assault is an underexplored but very critical issue within the Indian judicial frame work. The Indian judicial framework has the punishment for the rape convicts or the rapes which causes death of the victims but its lack at the terms of supporting the families of the victims, who faced the psychological trauma, social shame, ignorance by the government institutions. So, this research analyses the secondary victimization faced by the families of the victims who experienced such fatal sexual assault substantially concentrating on legal, psychological and systemic challenges. The research paper includes the recent legislative frameworks in India which is Bharatiya Nyaya Sanhita (BNS) and Bharatiya Nagarik Suraksha Sanhita (BNSS) and also The Protection of Children from Sexual Offences (POCSO) Act for the rape and fatal rape. In addition, there is a comparative study of Indian legislative framework with the international frameworks and suggest reforms and recommendation to ensure justice and rehabilitation for the families of the rape victims.
