Legal Recognition And Rights Of Children Born Out Of Wedlock: A Comparative Study Between India And Global Standards

ABSTRACT


Various laws lack a unified framework, with their governing principles having evolved over time. One such significant legal area of focus is the ‘Rights of children born out of wedlock.’ This research study examines the rights of children born out of wedlock in India and under various international frameworks. There is no single framework governing the rights of these children in India and the research aims to understand their rights under various personal laws and provisions. It aims to compare the rights of these children in India with their rights recognized under different international frameworks. It focuses on rights such as inheritance, maintenance, and guardianship, as well as the need to bring a single framework governing their rights in India which is in line with the global standards.
