ABSTRACT
Euthanasia is a controversial topic in the whole world but in India it is much bigger because of the customs and the values which the people follow. The legality of Passive Euthanasia in India is a big step taken by the court to protect the rights and interest of the citizens. In that case what is Passive Euthanasia and how in India passive euthanasia is legalized are a very big question. So, from what all cases the court raised the legality should be discussed and also what idea is put forward by raising it as a right should also be taken into account. This paper is mainly on the legality of Passive Euthanasia and through case laws how Passive Euthanasia become valid or legalized is discussed in the paper. The Aruna Shanbaug case is a milestone decision given by the supreme court. It not only given a judgement but also raised Passive Euthanasia as legal. The court also looked into the validity of living will as to whether an adult person can make a will to remove the life support and give him or her a peaceful death. In this paper what is Euthanasia, the landmark judgement paved way to the legality of Passive Euthanasia and also about Living will is also been taken into account.
