ABSTRACT
This paper examines the legal complexities surrounding parenthood for transgender individuals in India. The research investigates the current legal landscape and societal challenges faced by transgender individuals seeking to become parents. It explores the intersection of gender identity, reproductive rights, and parental recognition within the Indian legal framework. Furthermore, the study analyzes case laws, governmental policies, and social attitudes to assess the barriers and opportunities for legalizing parenthood among transgender communities. The paper aims to highlight the necessity for legal reforms to ensure equal parental rights and access to various pathways of parenthood, including adoption, assisted reproduction, regardless of gender identity. By addressing these critical issues, this research contributes to the ongoing discourse on inclusivity, equality, and human rights in India.
