ABSTRACT
Artificial Intelligence has perplexed the court of law. Especially in the widespread copyright violations done in the name of training large language models. For bare minimum in regulatory necessity we need to understand the importance of the intersections at play.The copyright violation, AI Governance, India’s interesting position in the AI race and Algorithmic Forensics. Looking at the compelling proposed Copyright Remuneration Collective for AI Training proposed by the Department of Promotion of Trade and Internal Industry; and it’s shortcoming in expecting corporations to be transparent. We dissect current regulations worldwide. Including AI Safety Institutes and their non-enforcement technical expertise that if given legal capacity could revoluntise AI innovation as well as intellectual property protection.
This essay dissects current copyright litigation, corporate realities, technical solutions and the liability of the Indian judiciary to foster legal innovation. Demanding accountability through AI auditing to prosecute those that choose to violate Indian Intellectual Property law in the name of technicality. While also balancing the Indian mission for national AI innovation. By the conclusion we will see investing in AI Data Lineage Engineering in regulation is a double-edged sword that both facilitates the vision for AI Innovation while protecting Indian intellectual property from exploitation.
