Limitation On The Capacity To Sue And Be Sued

ABSTRACT


Torts is a vast subject and is ever evolving. The capability of a person to sue and be sued under the law of torts keep changing time and again too. The general notion that exists with regards to capability of a person to sue and be sued is that, “any person can sue and be sued under the law of torts” , but in technical terms, not everyone can be sued under the law of torts and some of them do have immunity from being sued while there are a set of reasonable restrictions on whom can be sued. The researcher in this paper, scrutinizes the conditions under which an individual cannot be sued or sue someone and also looks at the evolvement of such limitations over the course of time.
