ABSTRACT
My paper examines the doctrine of basic structure in the Indian Constitution through an interesting chronological exploration of historical developments and judicial conflicts that shaped its emergence. Beginning from the history of constitutional background and the series of amendments that triggered debates on parliamentary supremacy over courts, the study traces how landmark cases progressively defined the limits of legislative power. By analysing these vital judgments and the legal controversies they generated, the paper highlights how these decisions influenced the making of laws and ultimately crystallized into the doctrine of basic structure as the Constitution’s most enduring safeguard. The research underscores that this doctrine not only arose from judicial evolution but also was a response to political and legal challenges, ensuring the preservation of India’s constitutional identity against arbitrary alterations.
