Live-In Relationships And The Issue Of Consent

ABSTRACT

It is well known that live-in relationships are on the rise and they challenge society's orthodox notion of marriage, but the legal implications of such relationships vary. Live-in relationship couple face numerous difficulties, for example from getting their parents’ consent to such lifestyle to getting a flat in a housing society. However, the legal aspect of these relationships are quite complex. Unfortunately, these relationships have often become a topic of debate mainly with respect to the issue of their statutory recognition. This article tries to delve into the issue of live-in relationship and their interaction with the concept of consent, how an occurrence of sexual offence or a false promise of marriage, within such relationships, has been dealt by the Indian judiciary and what role does this concept of consent play in such grave scenarios.
