Ch.Ch Priya Bhanu, Mahindra University, School of Law

ABSTRACT

Live streaming of court proceedings undoubtedly has the potential to give the general public a chance to watch court proceedings in real-time and give them a more direct sense of what happened than they would otherwise be able to because of logistical challenges and infrastructure limitations of courts. The introduction and integration of such technology would provide the viewing public with a virtual presence inside the courtroom and also inform them of how the court functions. The transmission of information about judicial processes and providing the litigant with full access to justice depend on the live broadcasting of proceedings. Without the litigant's ability to directly observe, hear, and comprehend the course of proceedings, access to justice cannot be fully achieved. Live streaming of cases that have constitutional importance really helps people but the legal system is unique and extraordinary. Their authority is based on constitutional clauses and procedural rules since they are the last arbiters of constitutional interpretation. This area of expertise enhances democracy. That is not always in opposition to the spirit of democracy and according to a popular claim that has gained traction recently.
