Marital Rape: A Crime Unsettled

ABSTRACT

Rape per se is a horrifying offense that violates the privacy, dignity, and self- esteem of the victim, and when such a horrifying act takes place within the four walls of the home it affects the psyche of the woman. It is critical to enact strict legal rules on the subject to bring marital rape up to parity with other rape offenses.

If we are to combat prejudice and injustice against women, we must begin at home, because if a woman cannot feel safe in her own home, she cannot expect to feel safe anyplace outside.

The goal of the study is to learn about the legal situation of marital rape in India. In addition to discuss the need for the criminalization of marital rape and recognition of mental anguish that a woman suffers. Although the penalization of marital rape will not end the problem, still an efficient and effective legal provision will surely help.
