Mediation In Family And Matrimonial Disputes

ABSTRACT

India is a country which includes about 1.324 billion people and the second most populated country in the world. It becomes difficult for our judicial system to look after all the petty to grave matters concerning its people therefore the ADR Act, 1996 gives alternative measures in resolving conflicts. The two basic pillars of Indian society are marriage and family. Our paper primarily deals with the specific branch of ADR i.e. Process of Mediation in dealing with divorce and other family matters as to when it is beneficial. A Court case involving family matters necessitates a unique approach. Today new approaches of resolving matrimonial disputes are crucial to save the family system, particularly mediation, which saves time and money. Through this paper the idea of mediation and its function in resolving matrimonial disputes is mentioned with the aid of using contemplating for the country`s diverse culture, and modern-day legal and social situation.
