North Sentinel Island Related Laws

Kriti Thyagaraj, Christ University

ABSTRACT

In the Indian Ocean lies the world's most forbidden island, the North Sentinel Island. This island is a part of one of the union territories of India. But it is surprising to see how many people are unaware of this mystical island, untouched by the modern world. The people of this island still lived how we humans lived during the stone age. Times existed when the Indian government tried to contact these people. But however, this led to the death of a few of the tribal people, as they were not immune to the disease that we are immune to i.e, even a common cold could kill them. Since then the tribals are reluctant to meet the people of the outside world. And the government also declared it a forbidden island. However, in 2018 they removed this restriction to promote tourism in the country.

It is surprising to see that hardly any research has been conducted on the laws related to these Indian citizens. We have acts passed with respect to these people like the Restricted Area Permit, Particularly vulnerable tribal group act, ANPATR (1956), etc. This research paper will have a detailed analysis of all the facts related to these people. The paper will also look into whether Sentinelese can be prosecuted under Indian law as they are after all Indian citizens. The paper will also try to explore the question of the responsibility of the Indian government toward the people of the island.
