ABSTRACT

Parallel Imports, an outcome of the International exhaustion principle, is indeed an exceptional limitation that is put upon the monopolistic rights of the patent owner. The aim of parallel imports is to make accessible patented products at a cheap rate to the consumers of a country to which it has been parallel imported. It is very crucial especially for a country like India and other developing and under developed countries since it is very much in need of access to patented products owing to its huge population. Further, the differential pricing techniques used by the Patent owners in supplying its products based on markets also make it necessary as well as conducive for parallel imports to exist.
