Prison Overcrowding And Its Impact On The Effectiveness Of Punishment In India: Challenges And Legal Implications

ABSTRACT


The overcrowded Population of prisons in India and its major Impact on Criminal Justice System, punishment and rehabilitation are examined in this paper. Overcrowded prisons not only demote the standard of prison also caused stress to the essential resources and efficient treatment and inmate’s rehabilitation. This paper study on how overcrowding population increased violence among prisoners which affect their mental and physical health. How shortage of employees and limited sources affect the Rehabilitation program such as education. It also study about how the prison system can contribute to a broader social solution rather than just a punitive one. What type of Challenges are there to finding solution to this problem. The study argues for a reassessment of criminal justice policies and the need to fund alternative sentencing systems to reduce prison overcrowding, enhance prisoner well- being, and promote effective reintegration into society. This paper study about prison data as per recent report and statistics and present case studies.
