Privacy Laws And Regulations: Comparative Analysis With Special Reference To The European Union

ABSTRACT
A critique of the data protection laws in India and a comparative analysis of these laws to that of the data protection laws in the European Union is presented in this research paper. In India, laws related to data protection are still in their infancy, and there needs to be more extensive legislation related to data protection right now. This is a significant problem as we are currently living in a digital age where everyone's personal data is being digitalized, and there is a high chance for the wrong person to get their hands on this data. Furthermore, this will lead to the misuse of this data. Due to these problems present in the digital world, countries are slowly creating laws concerning data protection online. Despite this problem, there needs to be proper legislation in our country to regulate data protection. This research paper examines the void in the current data protection laws in India and compares it to the laws of data protection present in the European Union, GDPR, is considered to be the standard that other countries must aim to achieve concerning data protection laws. After the comparison, recommendations will be given so that the data protection laws in India can be improved. Data for the research was collected by analyzing and compiling the data from ten articles (secondary data sources). After analyzing the articles, I found out that the laws currently active concerning data protection need to be revised and in need of an immediate law for data protection. However, the Data Protection Bill that is about to be passed into law by the Parliament will grant some much-needed relief as this will be India's first extensive data protection law when it becomes law.
