ABSTRACT
The Indian Judiciary plays a pivotal role in safeguarding prisoners' human rights, stepping in where other branches falter. Through consistent intervention, particularly by the Supreme Court, corrective measures are implemented, highlighting a dedication to human rights protection. Underpinning this effort is the interpretation of Article 21, establishing a framework to uphold prisoners' rights and preserve human dignity. Any transgressions are scrutinized through the lens of Article 14, ensuring equality before the law. Legislation such as the Prison Act of 1894 and the Criminal Procedure Code (CRPC) address violence against prisoners, but judicial oversight remains crucial. Recent actions by the Supreme Court demonstrate a vigilant stance against deplorable prison conditions, advocating for much-needed reforms. This proactive approach reflects the judiciary's commitment to rectifying systemic shortcomings and advocating for the most vulnerable in society. In essence, the Indian Judiciary emerges as a beacon of hope, actively safeguarding prisoners' rights and holding authorities accountable for any violations. Through innovative measures and unwavering dedication, it ensures that fundamental human rights, particularly the right to life and personal liberty, remain upheld, even in the face of institutional inertia.
