Rape Victims: The Judicial Approach And The Related Societal Problems

ABSTRACT

Sexual violence has no bounds. It occurs in every country and in every aspect of life. Millions of girls are sexually assaulted, molested or exploited every year all around the world. In India and round the globe, rape has been one of the most serious forms of sexual assault that not only physical injures a woman but leaves a scar for life. Even today, victims of rape face a lot of societal stigma and pressure. The society cannot be solely held responsible for the sufferings of a rape victim. The judiciary has also a role in it. There are several court rulings and judgments that normalize rape and turn the offence in a matrimonial alliance between the victim and the accused. In this paper, the researcher has thoroughly analyzed the nuances in such cases and their repercussion on the victim and the society.
