Recalibrating International Humanitarian Law In The Age Of Algorithmic Warfare

Mr. Mohd Ubais Ansari, Assistant Professor, Faculty of Law, Integral University, Lucknow

ABSTRACT

The rise of algorithmic warfare, driven by AI and autonomous systems, poses unprecedented challenges to International Humanitarian Law (IHL). This paper explores the legal and ethical dilemmas arising from machine-driven decision-making in armed conflict, including issues of accountability, distinction, and proportionality. It argues for a recalibrated IHL framework that integrates technological advancements while upholding core humanitarian principles. By analysing current gaps and understanding the evolution of warfare, the study seeks to ensure IHL changes with the time in order to remain effective in an era of rapidly evolving warfare technologies.
