Regulating Euthanasia In India & Analyzing Recent Indian Case-Laws In This Regard

ABSTRACT:


Whereas the evolution of laws pertaining to euthanasia is in process in many countries of the world, or at least a debate in this regard is ongoing at a social level across multiple realms, India too has joined the bandwagon towards regulating this concept, much thanks to the proactive intent shown by Indian Judiciary in this regard. This article opens up with providing an introduction to the concept of euthanasia and the statutory mechanism prevalent right now to regulate it in India. The article then goes on to delve into highlighting the key aspects of three prominent case-laws that stirred up and regulated the debate surrounding euthanasia in India during past one and a half decade and points out their salient features, which laid procedural guidelines on legalizing euthanasia within the territory of India in certain cases.
