Reproductive Rights Of A Women In India

ABSTRACT


An authenticated attempt to understand the definition, meaning of the reproductive rights, this study primarily focuses its attention upon decoding various components of reproductive rights which are integral part of human rights also. Efforts are also made to bring to the screen the existence of the Constitution in support of the reproductive rights of a woman. The study of exercise of right to abortion in the light of the Medical Termination of Pregnancy Act, 1971, use of pre-natal diagnostic techniques under the Pre- conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994 and provisions relating to miscarriage under the Indian Penal Code, 1860. A sincere endeavour is also made to delineate the boundaries of reproductive rights in the light of existing assisted reproductive technologies, including surrogacy in it which aims to help the infertile couples in having children of their own. In the end, this research work provided a conclusion with a complete understanding of the reproductive rights of a woman in India.
