Role Of Right To Information In Seeking Environmental Justice

Dr. Chandreshwari Minhas, Assistant Professor, Himachal Pradesh National Law University, Shimla

ABSTRACT

Right to Information is a powerful tool for seeking environmental justice. This is considered as the most important legislation in view of the high levels of corruption in almost all spheres. The information in environmental matters includes access to environmental impact assessment reports, environmental clearances, permissions and licenses provided by various ministries, reports on policies and recommendations, reports on industrial development and effluent levels amongst others. Although the country has a comprehensive environmental regulatory framework with over forty-three environment specific legislations, the Right to Information Act is the first of its kind that allows citizens to access critical environmental information that can have a detrimental effect on health, safety and development. India stands the risk of being crippled by loss of natural and human health. Given this background, this research article aims to evaluate the performance of the Right to Information Act in securing environmental justice in India.
