Sale By Description: A Critical Analysis

ABSTRACT

The Sales of Goods Act, 1930, is a central act that deals with the laws governing buying and selling of goods in India. In addition to this, the Indian Contract Act, 1872 is applicable to these transactions. There are few conditions that are necessary for the efficient functioning of such contracts. These conditions could be implied or expressed. In this article, the implied conditions in a contract of sale of goods, with special reference to Section 15 i.e., Sale by Description, will be analysed.
