Same-Sex Marriage And Adoption: Legal Challenges And Social Change

Alka Tripathi, Practicing at the Lucknow Bench of the Allahabad High Court

ABSTRACT

This paper explores the intersection of same-sex marriage and adoption, focusing on the legal challenges and social transformations associated with these rights. With the increasing recognition of LGBTQ+ rights globally, the issue of marriage and family formation has moved to the forefront of legal and social discourse. This paper critically examines the current legal frameworks, key case laws, and socio-cultural attitudes towards same-sex couples seeking marriage and adoption rights. It also addresses the psychological and developmental impact on children raised by same-sex parents, the intersectionality of race and class, and the global perspectives that influence local legal reforms. Finally, it proposes comprehensive recommendations for policymakers, legal practitioners, and social activists to ensure equality and inclusivity in family rights.
