Securing Trade Secrets: An Overview Of Legal Framework Under Indian Contract Act 1872

ABSTRACT

Trade Secret is a type of Intellectual Property asset, essentially which is what I would call almost a miscellaneous bucket of Intellectual Property and the reason for that is because usually things that are not protected by Patents, Trademark or Copyrights, companies will try to protect them under Trade Secret law. Since there is no legislation till now in India to protect Trade Secret and the available protection is given only under the Contract Act 1872. In this paper I want to throw some light on the related provisions of Contract Act and also discuss some pros and cons of this concept. I would also like to mention some preventive measures which should be taken by the holder of a trade Secret to prevent the proposed threats.
