ABSTRACT
The paper discusses the constitutional framework, laid down for the formation of new States under Article 3 of the Constitution of India. The paper seeks to answer the question whether the said provisions are in sync with the concept of federalism as envisaged by the Constitution of India and further how does the reorganization impact federal features, creates new challenges for the both the states. It is often contended that Article 3 of the Constitution of India provides the Centre with unchecked unilateral arbitrary power while re-organization of States and has been grossly misused by the successive central governments to secure political mileage.
The paper analyses the above contention in the light of the formation of Telangana as 29th State, where it points towards the need for consulting the concerned states legislatures whose boundaries and area is going to be restructured.
