Striking A Balance: Exploring Judicial And Legislative Measures In Poverty

ABSTRACT


A challenging task in the pursuit to end poverty is the balancing of legal mechanisms to foster social justice and economic emancipation. This paper examines the mutually dependent dynamics between judiciary and legislature that are required to enact effective measures for alleviating poverty. As an introduction, this study also appreciates that judiciary remains a key component when it comes to defending and interpreting rights of the poor. The legal terrain of poverty eradication is considerably shaped by judicial actions such as monumental verdicts and relevant precedents. Courts’ interpretation of constitutional principles through case studies from different jurisdictions offers valuable insights into how law can be used in a holistic approach towards tackling poverty. Legislative initiatives emerge simultaneously as an essential tool to fight against poverty. This abstract scrutinizes many legislative measures which include social welfare programs and economic policies to find out how statutes influence poverty reduction. The exploration is aimed at identifying the best practices in legislation as well as highlight some of the areas that need to be improved, thus recognizing the necessity for adaptable and integrative policies whose nature encompasses multiple sides of destitution. Balancing this right involves harmonizing legal principles with pragmatic ones based on empirical data, hence creating an environment that fuses rule of law with socio-economic advancement. Thus, this abstract forms part of a continuing conversation about poverty by showing how judicial and legislative arms go together. Its purpose is to help those dealing with policy decisions, practicing law or conducting research when they are coming up with holistic frameworks that can enable them tackle the issue of poverty effectively through an examination of success stories and possible barriers.
