ABSTRACT
The rule of law is the cornerstone of every democratic society and it depends upon an independent judiciary capable of delivering judgments free from any external influence, as well as an executive committed to complying with those judicial orders. However, the persistent non-compliance with judicial orders by government authorities in India poses a significant challenge to constitutional governance, weakens judicial authority, and erodes public trust in the justice delivery system. This paper critically examines the legal and constitutional framework governing the enforcement of judicial orders, with a particular emphasis on the Contempt of Courts Act, 1971, and relevant constitutional provisions. It further analyses some judicial precedents to identify the practical and institutional challenges that obstructs in the effective enforcement against government authorities. The paper argues that existing mechanisms have often proved inadequate in ensuring timely compliance and maintaining executive accountability. To address these shortcomings, it proposes pragmatic reforms, including enhanced personal accountability of public officials, the imposition of financial penalties, the establishment of dedicated monitoring mechanisms, and greater transparency through public reporting. These reforms aim to strengthen the enforcement of judicial orders, reinforce the rule of law, and uphold the supremacy and authority of the judiciary in India's constitutional democracy.
