The Challenges Of Triple Talaq For Muslim Women’s Quest For Equality

ABSTRACT


India's talaq-e-biddat (triple talaq) controversy has hit a hotbed at the intersection of religious freedom, gender equality, and constitutional morality. This article examines whether efforts to prohibit the practice really empower Muslim women or work to advance the reductionist binaries of tradition vs modernity, although these efforts have been described as progressive legislative measures. This article analyzes how the figure of the "victimized Muslim woman" has been used within a liberal rights paradigm that all too often disregards the complex intersection of gender and religious identities, based on the Shayara Bano petition and court decisions following it. The feminist jurisprudence respected in this paper relies on intersectionality and recognizes that Muslim women's liberation has to be negotiated within, not against, their religious worlds.
