The Death Penalty: Ethical Dilemmas And Deterrent Effects

Animesh Pundir, Indian Institute of Management, Rohtak

ABSTRACT

The death penalty remains one of the most contentious issues in contemporary society, raising profound ethical questions and debates about its effectiveness as a deterrent to crime. This research paper delves into the ethical dilemma surrounding capital punishment, exploring arguments rooted in moral philosophy, justice, and human rights. It critically examines whether the death penalty serves as a robust deterrent against heinous crimes, using empirical data and comparative analysis from global legal systems. By analysing the interplay between ethical considerations and practical outcomes, this study aims to provide a balanced perspective on the death penalty's relevance in modern jurisprudence. The paper concludes with recommendations for policymakers and stakeholders, emphasizing the need for an evidence-based approach to address the complexities of this issue.
