ABSTRACT


The Digital Personal Data Protection Act, 2023, represents a giant leap in India's data protection's path. This legislation aims to strike a balance in between safeguarding an individual’s privacy rights and addressing national security concerns. This article provides an in-depth analysis of the Act's provisions, examining the tensions between data protection, surveillance, and national security. The author assesses the impact of the act upon the individuals, businesses, and government agencies, highlighting potential challenges and opportunities for effective implementation. Through a critical evaluation of the Act's balancing act, this article aims to contribute to the ongoing debate on data protection, privacy, and national security in the digital age.
