ABSTRACT


This paper examines the evolution of sex worker rights in India within the constitutional framework. It delves into the historical context of sex work in India, highlighting the impact of colonialism and subsequent legislation like the Immoral Traffic Prevention Act, 1956. The evolution of legal frameworks, marked by landmark court judgments, is explored, emphasizing the recognition of sex workers' rights as fundamental. The constitutional framework, particularly Articles 14, 19(1)(g), and 21, is analyzed in the context of sex work. Challenges faced by sex workers and the way forward are discussed, including the potential impact of regulation on reducing sex crimes. The conclusion presents a nuanced perspective on legalizing prostitution in India, advocating for a public health approach and stringent regulations to ensure worker safety and rights.
