The Feasibility, Utility And Acceptability Of The Uniform Civil Code In The Light Of The Pluralistic Features Of The Indian Society

ABSTRACT


The contentious debate surrounding the Uniform Civil Code (UCC) in India, which has sparked intense discussion on the intersection of secularism, personal laws, and freedom of religion. In this article, we have discussed about the Constitution’s drafting history which reveals a strong inclination towards reforming personal laws to enhance women’s rights; but the UCC’s enactment has been hindered by concerns about violating religious freedom. This paper explores the tensions between unity and diversity in a pluralistic society like India, arguing that effective restrictions on individual freedoms are necessary to protect the marginalized communities and preserve the country’s diverse social fabric.
