The Freedom Of Speech And Expression In India With Particular Emphasis On Cinema

Introduction

Freedom of speech and expression is a fundamental right guaranteed by the Constitution of India under Article 19(1)(a).1 This right enables every citizen to express their opinions, ideas, thoughts, and beliefs freely, without fear of censorship or repression by the state. The right to freedom of speech and expression is essential to a democratic society as it allows individuals to participate in public discourse and debate, which is crucial for developing a vibrant and pluralistic society. It allows citizens to express their opinions and beliefs without fear of persecution or discrimination.

However, the Constitution of India also imposes reasonable restrictions on exercising the right to freedom of speech and expression.2 These restrictions are necessary to protect the sovereignty and integrity of India, maintain public order, and prevent defamation, contempt of Court, incitement to an offence, and other offences.

In India, the freedom of speech and expression has been tested repeatedly, particularly regarding controversial issues such as religion, politics, and national security. Despite the challenges, the right to freedom of speech and expression remains a fundamental pillar of democracy in India. It is essential for protecting individual liberty and promoting social progress.
