ABSTRACT

This study investigates the impact of anti-dumping duties on competition in the Indian market, with a focus on the role played by the Competition Commission of India (CCI). Anti-dumping duties are trade remedies aimed at countering unfair trade practices, particularly dumping, which can harm domestic industries. However, the imposition of these duties can also affect the dynamics of competition and the overall market structure. This study aims to analyze the legal framework surrounding anti-dumping duties in India, examine the effectiveness of the CCI in regulating such measures, and evaluate their consequences for market competition. By conducting a comparative analysis with international practices, we gain insights into the interplay between anti-dumping measures and competition regulation. The findings contribute to the existing literature by providing a comprehensive understanding of the relationship between anti-dumping duties and competition in the Indian context. Moreover, this research offers policy recommendations to optimize the regulatory landscape, ensuring a balanced approach that protects domestic industries while fostering a competitive environment. By bridging the gap between academia and real-world implications, this paper provides valuable insights for policymakers, industry stakeholders, and scholars interested in competition law and trade regulations. Ultimately, our study aims to promote fair and sustainable competition in the Indian market, contributing to economic growth and consumer welfare.
