The Impact Of Bharatiya Nyaya Sanhita, 2023 On Indian Criminal Jurisprudence: A Critical Analysis

ABSTRACT


With the adoption of the Bharatiya Nyaya Sanhita, 2023 (BNS), India's criminal justice system—which was mostly founded on the colonial-era Indian Penal Code, 1860 (IPC)—saw a significant transformation. The goal of the new law is to "Indianize" and modernize criminal law by emphasizing victim rights, citizen-centric government, and the incorporation of technology innovations. This study examines the BNS's effects on substantive criminal law critically, highlighting important conceptual modifications, definitional adjustments, procedural advancements, and sentence reforms. The article goes on to examine how the BNS addresses current societal demands while redefining the fundamentals of Indian criminal jurisprudence. Additionally, it talks about the new code's advantages and disadvantages as well as how it may affect India's changing legal system in the future. The research evaluates whether the BNS effectively reconciles tradition and modernity in Indian criminal law using a critical analysis and comparative viewpoint.
