The Impact Of Environmental Litigation In India: With Reference To Illegal Mining

Isha Tiwari, LL.M., School of Law, University of Petroleum and Energy Studies, Dehradun

Introduction

One of the most divisive human endeavours and one of the hardest to incorporate into the paradigm of sustainable development is mining1. There isn't much we can accomplish that doesn't require mining. However, mining can have a significant negative impact on the environment, as seen in the instance of the "Iron Mountain" mine, which will continue to pollute its surroundings for 3000 years. Acid draining from mines is a major issue in the mining industry. It is also one of the biggest and most significant environmental problems facing mining. The extraction of minerals is a very essential for the country’s economy but on the other hand this mineral extraction is abusing the environment. Most of the energy resources that we use is possible because of the mining activity, the rough material is usually provided because of mining.

Mining activities produces a large amount of waste which has very deleterious effect on earth surface and a great threat to environment. Mineral extraction if also done in area which has greater landmass or far from the place developed still it has a very harmful impact on environment and even to the public health and also a threat towards wildlife and flora and fauna of that area. The raw materials which are extracted through mining and refined in the industries are later on supplied in market like: cement, gold, coal, etc.
