The Impact Of Legalisation Of Prostitution In India

Chetna S, B.A.LL.B. (Hons.) Sathyabama Institute of Science and Technology (School of Law)

ABSTRACT

This article examines the correlation between societal norms and the law as it pertains to prostitution. It proposes the elimination of laws and restrictions surrounding prostitution to classify it as a lawful business by providing rights and precautions for all parties involved and legal remedies for those who suffer damages or require compensation. The article will present evidence supporting the claim that legalising or at least decriminalising prostitution can lead to a reduction of sexual offences1.

Introduction

Prostitution is the exchange of sexual services for money or something of monetary value. In South Asian countries, particularly in India, prostitution carries a strong negative stigma that often prevents one from considering the benefits of legalising it2. The purpose of this article is to analyse how the legalisation of prostitution can contribute to lower the rate of sexual offences such as rape committed in India.
