ABSTRACT
Under the guise of sacrosanctity of the institution of marriage a millennium has elapsed in the denial of women's fundamental rights, including the prohibition of marital rape. Our nation is very hesitant to declare marital rape a crime in this day and age when gender equality is trying to find its place. Even though marital rape is a prevalent and repulsive kind of masochism in the world, the perpetrator's relationship to the victim is thought to be sufficient justification for not classifying it as a crime. Rape is often considered to be one of the most heinous crimes but the same crime has gone unnoticed by the same society because they are deceived by the concept of marriage and the cultural norms it is associated with. The problem of marital rape is not local or regional. Both gender discrimination and male domination over women are widespread issues. Although the male's role in the relationship shifts from father to spouse to son, power still rules. The issue of male dominance in marriage takes the form of marital rape. No effort is finished in today's globalized society unless its international relevance is recognized.
