The Misuse Of Section 498a Of Indian Penal Code: Safeguards And Solutions

ABSTRACT


Section 498A of the Indian Penal Code was introduced to safeguard women from atrocity and importunity within marriage, particularly dowry- related abuses. While it has been necessary in addressing genuine cases of domestic violence, its abuse has surfaced as a concerning issue. Some individualities have exploited this provision to settle particular scores, leading to false allegations, dragged action, and overdue importunity of the indicted. This has caused emotional, fiscal, and social impacts for families and has raised questions about the need for checks and balances to help abuse. This paper explores the counteraccusations of similar abuse and suggests reforms to balance justice and fairness while securing the original intent of the law.
