ABSTRACT


This research paper delves into the multifaceted challenges faced by half- widows in the conflict-ridden region of Kashmir, where thousands of women find themselves in a liminal state of uncertainty and vulnerability due to the unresolved political and social turmoil. Half-widows are women whose husbands have gone missing or disappeared due to the prolonged conflict in the region, leaving them in a precarious legal and social position. Through a socio- legal analysis, this paper examines the intersection of cultural, legal, and human rights dimensions of the half-widows' predicament. It explores the historical and political context of Kashmir's conflict, the legal frameworks, and the international human rights standards that should protect their rights, and the socio-cultural factors that further complicate their lives. The research paper also investigates the challenges faced by half-widows in accessing legal remedies, obtaining information about their missing husbands, and securing economic and social support. It critically evaluates the effectiveness of existing state and international mechanisms in addressing their issues and provides recommendations for improving their legal and socio-economic conditions. Ultimately, this study underscores the urgent need for a comprehensive approach to address the plight of half-widows in Kashmir, one that combines legal reforms, social support, and reconciliation efforts, and seeks to empower these women who have long suffered in silence and uncertainty.
