ABSTRACT


In this paper the researcher has tried to analyze the Judgment of the Honorable Supreme Court in the case of Arjun Gopal v. Union of India and critically examined the legislative intent of the Supreme Court drawing a clear attention towards the degradation of air quality index across the country. The alarming situation has arrived and calls for a clear and bold decision as a matter of right, right of living in a healthy environment vested under the Constitution of India, right to breathe fresh air, pollution free environment. The researcher has tried to give a deep insight of the case along with a precise explanation of the basic fundamental right, Right to grow in a Healthy Environment.
